The following terms govern your use of any and all data, text, software, code libraries, software development kits, tools, documents and other materials associated with the PitchPrint Application Programming Interface as offered by PitchPrint, Inc.

MODIFICATION.

PitchPrint, Inc. reserves the right to change these Terms of Service. You are responsible for reviewing these Terms of Use each time you use our Products and / or Services. Your continued use of our Products and Services constitutes your agreement to the then current Terms of Use.

GRANT OF LICENSE.

Subject to your ("Licensee") full compliance with all of these Terms, PitchPrint, Inc. grants Licensee a non-exclusive, revocable, non-sublicensable, non-transferable license to download and use the Software solely to embed a launchable PitchPrint application within Licensee’s Website application ("App") and to access data from PitchPrint, Inc. in connection with such application. Licensee may not install or use the application for any other purpose without PitchPrint, Inc.’ prior written consent. Licensee shall not distribute (for free or at a cost) any custom content through its implementation of the PitchPrint API without PitchPrint, Inc.’ prior written consent.

USE OF PITCHPRINT APPLICATION PROGRAMMING INTERFACE.

Our Software is delivered in good, tested and functional state. Our Software and Services go through rigorous testing programs for potential errors and malfunctioning and have been cleared fit. However any fault arising from the use of the software shall not be a liability of PitchPrint, Inc.

You will not use our Products and Services feature, including the Services and Materials, for any unlawful purpose, or in any manner or for any purpose which is prohibited by these Terms of Use.

LOGOS AND INFORMATION.

All logos and information from external sites are the copy-protected property of their respective owners. Please do not duplicate or use these items (images, slogans etc) without requesting permission from the owner.

LANGUAGE TRANSLATION.

It is the express wish of the parties that the Terms of Use and all related documents have been drawn up in English. C'est la volonté expresse des parties que la présente convention ainsi que les documents qui s'y rattachent soient rédigés en anglais. The English version of these Terms of Use will be the version used when interpreting or construing these Terms of Use.

GENERAL.

These Terms of Use and the other rules, guidelines, licenses and disclaimers posted with our products and /or services constitute the entire agreement between PitchPrint, Inc. and you, with respect to your use of Services and Materials, and supercede any prior representations, discussions, undertakings, communications or advertising relating thereto.

If for any reason a court of competent jurisdiction finds any provision of these Terms of Use or portion thereof, to be unenforceable, that provision will be enforced to the maximum extent permissible so as to effect the intent of the parties as reflected by that provision, and the remainder of these Terms of Use will continue in full force and effect. Any failure by PitchPrint, Inc. to enforce or exercise any provision of these Terms of Service or related right will not constitute a waiver of that right or provision.

The section titles used in these Terms of Use are purely for convenience and carry with them no legal or contractual effect. Nothing in these Terms of Use is intended to be, or will be construed as, altering, revising, modifying or otherwise amending any agreement, arrangement or understanding between you and PitchPrint, Inc.
